Intent of Use
Entrants whose Artwork is selected for any End Use (“Selected Artwork”) will receive compensation based on the scope of the project, intended usage, scale of work, production requirements and licensing requirements. Compensation amounts will be determined through mutual negotiation between the Artist and the Company prior to final approval and installation.
The Company is committed to fair artist compensation and collaborative partnerships. Payment terms, usage rights, installation timelines, production support, and any additional licensing fees for expanded applications — including but not limited to merchandise, apparel, digital campaigns, video content, press materials, or promotional initiatives featuring the mural artwork — will be discussed and agreed upon in writing with each selected Artist.
Artists retain ownership of their original Artwork and mural concepts. The Company will never sell Entrant’s Artwork to any arm’s length third party without the Entrant’s express written consent. The Company is not an image brokerage.
Where additional uses beyond the originally agreed End Use are requested, additional compensation will be negotiated in good faith based on the nature and duration of the expanded usage.
Selected artists will create original mural installations on the exteriors of select 7-Eleven locations across Canada. Your artwork may be photographed and featured in digital and print promotional materials, including social media content, websites, video, press materials, and other marketing collateral related to the project for no more than 18 months commencing when your mural is first unveiled (the “Term”).
After the Term is up, images of your mural may remain displayed on our social media platforms or website for archival purposes (“Archival Uses”), but will not be used in new promotional campaigns without additional permission.
To promote and commemorate the project, we would also like to feature you, your story, and your artwork across our social media platforms and promotional materials connected to the mural series.
Each person who submits Artwork (“Entrant”) must be of legal drinking age in the province or territory in which the artist resides at the time of entry.
Artwork must be original art derived from an original concept created by the Entrant. The Artwork may be an existing work; we do not require the Entrant to create anything new. The submitted Artwork must not contain obscene, provocative, defamatory, sexually explicit or otherwise objectionable or inappropriate content, as determined by the Company, in its sole and unfettered discretion. The Company reserves the right to examine the original Artwork and source material in order to confirm compliance.
Entrant acknowledges and agrees that, as between Entrant and the Company, the Company retains all intellectual property rights for all patents, trademarks or other names and intellectual property associated with the End Uses, and Entrant shall not have any rights therein except as may be expressly provided for in these Terms. For greater certainty, Entrant shall have no rights in and to the distribution of the products under the Company’s brand, or the use of the Company’s intellectual property rights for the promotion of the Products.
